Delaware’s DExit Nightmare Continues: Avelo Bolts for Booming Texas

December 19, 2025

Delaware Republican Party

While Delaware Democrats are pushing to burden hardworking Delawareans with even higher taxes through reckless policies like House Bill 255, they're also hell-bent on destroying our proud status as the nation's premier haven for major businesses and corporations, threatening one-third of our state's general revenue.

• Just days ago, Houston-based Avelo Airlines—the only commercial airline serving Delaware, anchoring over 100 local jobs at Wilmington’s New Castle Airport—signed a major deal to open a new base at Texas’s McKinney National Airport.

• This move will create well over 100 new jobs in Texas, lured by the Lone Star State’s zero corporate income tax, business-friendly courts, and relentless pro-growth policies. While Delaware families watch in growing fear that our state’s only airline is shifting its future south, one thing is crystal clear: One-party Democrat rule is bleeding Delaware dry—driving jobs, investment, and hope out of our communities. We can’t wait another day for conservative change to stop the exodus.

Why Avelo is Betting Big on Texas

• Explosive Job Creation: Over 100 new positions in North Texas—contrasting sharply with Delaware's stagnant economic signals under Democrat policies.

• Pro-Business Magnet: No state income tax, stronger liability protections, and business-friendly courts that prioritize innovation over litigation.

• CEO's Enthusiasm: Andrew Levy declared, "We are very excited to be the launch airline at TKI," praising Texas's "easy-to-use, small airport" model that residents will "enthusiastically embrace."

• This Texas triumph follows the broader DExit surge in 2024–2025, ignited by Delaware's activist Chancery Court voiding Elon Musk's shareholder-approved $56 billion Tesla compensation—a ruling critics slammed as judicial overreach favoring trial lawyers over executives and investors.

Core Drivers Fueling the DExit Firestorm

• Activist Judicial Overreach: Excessive "entire fairness" scrutiny on executive pay, fiduciary duties, and controlling shareholder deals—eroding board confidence and spiking litigation risks.

• Burdensome Costs: Delaware's franchise taxes (capped at $250,000 for giants) pale against Texas/Nevada's zero or minimal equivalents.

• Weakened Protections: Competing states offer ironclad director/officer shields, leaving Delaware boards exposed.

High-Profile Companies Fleeing Democrat Dominance

• To Texas: Tesla (full reincorporation), SpaceX, and Coinbase – plus operational booms like Avelo's new airport hub.

• To Nevada: Dropbox, TripAdvisor, Roblox, Pershing Square (Bill Ackman).

• Others: Trump Media & Technology Group (Florida).

• In 2025 alone, 18 major companies proposed leaving Delaware, with many citing unpredictability from activist rulings. While departures remain a fraction of Delaware's 2+ million entities, the trend is accelerating—and the damage is real.

Democrats' Patchwork Fixes: Desperate and Inadequate

• 2025's Senate Bill 21 offered minor tweaks to transaction rules and inspection rights—a panicked reaction to bleeding revenue, not bold reform. Meanwhile, Texas and Nevada aggressively court businesses with cutting-edge laws.

Real Pain for Delaware Families and Taxpayers

• Corporate fees fuel over one-third of our state's general fund revenue (~$1.8+ billion annually). Every high-profile shift—from Tesla's HQ move to Avelo's Texas jobs boom—chips away millions, threatening higher taxes, slashed services, and lost jobs for hardworking Delawareans. With no sales tax, we can't gamble our economic engine on continued one-party complacency.

2026: Our Moment to Fight Back and Win

• The DExit crisis and signals like Avelo's Texas pivot stem directly from years of Democrat control, enabling judicial activism over pro-growth policies. Delaware Republicans stand unwavering for limited government, fiscal responsibility, lower taxes, and policies that attract—not repel—jobs and innovation.

• In our small state, every seat counts. As 2026 midterms loom, Delaware Republicans are forging an unbreakable conservative coalition to flip seats, shatter one-party rule, and defy polls predicting Democrat dominance
