Senator Buckson Introduces Constitutional Amendment to Establish Term Limits in Delaware

Senator Eric Buckson (R-South Dover) on Tuesday introduced Senate Bill 222 (SB 222), legislation proposing an amendment to the Delaware Constitution to establish term limits for members of the Delaware General Assembly and several statewide elected offices.

SB 222 is the first leg of a two-step constitutional amendment process and would limit state senators to five elected terms and state representatives to eight elected terms. The legislation would also impose a two-term limit on the offices of Attorney General, Insurance Commissioner, Auditor of Accounts, and State Treasurer.

“Long-standing public conversations around term limits reflect a desire for accountability and renewal in government,” said Senator Buckson. “The aim of this amendment and term limits are to keep our institutions responsive to the people they serve.”

Under the proposal, any service completed prior to the amendment’s implementation would not count toward the newly established term limits. The limits would apply beginning with the next election held for each affected office after the amendment is fully adopted.

Senator Buckson emphasized that the proposal balances reform with fairness and respects voters’ rights while encouraging citizen-led government.

“Term limits are not about targeting individuals, they are about restoring trust in government,” Senator Buckson said. “This constitutional amendment allows elected officials time to build relationships and be effective in their roles, while also acknowledging that there should be an end point.”

Because the legislation proposes changes to the Delaware Constitution, it requires approval by a two-thirds vote of both legislative chambers and must be passed again by the next General Assembly following the next general election.

SB 222 has been assigned to the Senate Executive Committee. A committee hearing will be announced at a later date.
