Senate Passes SB 332 to Clarify Transferability of Special Vanity License Plates

DOVER, DE — Senate Bill 332, sponsored by Senate Republican Whip Brian Pettyjohn (R – Georgetown), passed the Delaware State Senate today and now advances to the House of Representatives for further consideration.

SB 332 amends Title 21 of the Delaware Code relating to special vanity license plates. The legislation clarifies that special vanity license plates, which are considered personal property in Delaware, may be transferred from one owner to another as a gift or for consideration. The bill specifies that such a transfer does not constitute a new issuance or reissuance of a plate.

The measure is intended to provide legal clarity in light of a U.S. District Court injunction that restricts the Division of Motor Vehicles from issuing new special vanity license plates or recalling those already issued. SB 332 guarantees that existing plate holders retain the ability to transfer ownership while remaining compliant with the court order.

Senator Pettyjohn said the legislation addresses a narrow but important issue for Delawareans who value these personalized plates.

“Special vanity plates often carry personal meaning and value, and this bill simply makes clear that owners can transfer them without creating legal uncertainty,” said Senator Pettyjohn. “We are respecting the existing court order while also preserving the rights of Delawareans who already lawfully own these plates. This is a practical clarification that protects both.”

SB 332 now heads to the House of Representatives for consideration.
