SB33 Exposed: The Vote That Locked In Higher Energy Costs for Delaware Families

January 24, 2026

by Rep. Bryan Shupe

In 2021, the majority party modified the Renewable Energy Portfolio Standards Act, continuing to raise unattainable green energy mandates for electric companies all the way through 2035.

They also removed a key consumer protection from the law. That protection allowed for a cost cap mechanism that could freeze those mandates if or when compliance costs exceeded 1 percent of total retail electricity costs. In other words, it was a built in safeguard for ratepayers.

Former Representative Briggs King even filed an amendment to keep that cost cap in place. It failed on party line votes. See the video.

So SB 33 did two things at the same time. It increased green energy mandates and it removed the very consumer protection designed to stop those mandates from driving up electric bills.

This is exactly how the majority party did not just give in to national party politics, but also to big power companies. And it is why Delaware families are now facing ever increasing electric bills.

Do not let them rewrite history or pretend they were not an integral part of creating this problem.
